The website sells Parmigiano Reggiano and other food and non-food products.

– General Provisions –

Any sale made on the Site constitutes a distance contract governed by Legislative Decree September 6, 2005, no. 206 – Consumer Code – Chapter I°, Title III° Articles 45 et seq. and Legislative Decree April 9, 2003, no. 70, on electronic commerce. These Terms and Conditions apply to all sales made through the Site. The same shall prevail in case of conflict with other provisions and operating instructions contained in the same.
The applicable Conditions of Sale are those in force at the time the order is sent. The sending of the order by the Customer shall be considered as acceptance of the conditions of sale in force at that time.
Fattoria Rossi undertakes to ship goods in conformity, undamaged and checked.

– Web Site Purchases –

Pursuant to art. 3, I paragraph, lett. a) of the Consumer Code, it should be noted that are considered “consumers” natural persons who purchase products for purposes unrelated to their entrepreneurial, commercial, professional or craft activities.
The submission of any purchase order by the buyer implies full and unreserved acceptance by him of the general conditions of sale.
The purchaser declares that he/she is of legal age to purchase alcohol.

Fattoria Rossi Società Agricola has the right to accept or not, at its own discretion, the order sent by the customer, without the latter being able to make claims or rights of any kind, for any reason whatsoever, including compensation, in the event of non-acceptance of the order.

Fattoria Rossi Società Agricola reserves the right to take action against orders that are abnormal in quantity or frequency of purchases.
Fattoria Rossi Società Agricola may refuse or cancel orders that come from users with whom there is an ongoing legal dispute, from users who have violated previous conditions of sale, or from users who have provided untrue data.

– Registration Users to the Web Site –

Registration on the Site is optional and allows you to speed up the purchase process. To register, you must fill out the appropriate form by entering your e-mail address and a password. The user agrees to promptly notify the company of any suspected misuse or unauthorized disclosure of his or her login credentials.

The purchase of our food products through the site implies that the customer has read and understood the following conditions. It should be noted that all information provided on the products, including ingredients and allergens, can be found in the product sheets and labels. However, we cannot guarantee the absence of cross-contamination or the total absence of allergens, as products are prepared in shared environments.

The customer is responsible for carefully verifying the information provided and consulting a physician or expert in case of food allergies or intolerances. Our company accepts no responsibility for any allergic reactions or health problems resulting from the consumption of our products. By purchasing our products, the customer declares that he/she has read and accepted these conditions and assumes all responsibility regarding the choice and consumption of food.

– Prices –

All prices shown on the Site include VAT. Any customs duties, charges and taxes are the responsibility of the buyer. The company reserves the right to change prices at any time. The price charged will be the price displayed at the time of order.
Shipping charges, if any, are clearly indicated before order confirmation. Selling prices of products on www.fattoriarossi.com may be different from those in our stores.

– Invoice –

In order to obtain an invoice, you must indicate your VAT number, company name (SDI code for Italy) when filling out the order. It will not be possible to request it later. Online sales are not subject to the requirement of tax certification (so no receipt is issued) under Art. 2, para. 1 of Presidential Decree. 696/1996

– Purchase Orders –

All orders are confirmed via e-mail and will be processed within 5 business days unless otherwise notified. You are responsible for the accuracy of the delivery information provided. Changing the shipping address after the order has been submitted will incur an additional charge.

– Payment Methods –

The Site accepts the following methods of payment:
– Credit/debit cards
– Satispay, Paypal, ApplePay, GooglePay
– Bank Transfer (the goods will be shipped only after crediting our bank account)
– Cash on Delivery (only in Italy with an additional cost of € 5.00) payment can be made only and exclusively in cash to the courier upon delivery of the products. The courier accepts only exact sums, corresponding to the amount of the order (no change).
– Payment in store
N.B. we do not accept payment by check or postal slips. In the case of large amounts we reserve the right to require a deposit by bank transfer as a deposit.

– Shipping –

We ship by express and refrigerated courier. Shipping charges are calculated based on the weight and size of the package as well as the destination of the goods and, if applicable, are clearly stated before the order confirmation.
We constantly strive to offer a product that is always fresh by preventing goods from sitting in courier warehouses; therefore, we pay close attention to the days on which to have goods leave our warehouses.

Fattoria Rossi Società Agricola cannot be held responsible for any courier delays. Any delays in delivery do not entitle the customer to refuse delivery of the products, nor to claim compensation or indemnity of any kind.

Upon delivery of the goods, the Customer is required to check that the number of packages corresponds to what is indicated in the waybill of the courier and that the packaging is intact, undamaged and / or altered, even in the closing materials. Any damage or mismatch in the number of packages must be immediately contested to the courier, putting the words “I accept with reservation right ” on the document and confirmed immediately by email info@fattoriarossi.com or via WathsApp 0522886813 to our office.

Goods accepted without affixing the required marking cannot be claimed for damage or shortage during transportation. In case of rejection of the goods by the customer or non-delivery for other reasons (wrong address and/or phone number of the recipient, repeated absence of the recipient) Fattoria Rossi soc. agr. will retain the full amount of the order.

– Right of Withdrawal –

The right of withdrawal does not apply to food products that are likely to deteriorate rapidly, as
provided for in Article 59 of the Consumer Code.

Products sold on the Site are likely to deteriorate or expire quickly and are not suitable for return for hygienic or health protection-related reasons. For this reason, the rules on the right of withdrawal do not apply, since otherwise the seller would be unable to resell products that are no longer usable by buyers. For non-food products, the user has the right to withdraw from the contract within 14 days of receipt of the goods, in the manner described. In all cases of returning goods, transportation costs are the responsibility of the customer.

– Legal Warranty –

All products sold are covered by the Legal Guarantee of Conformity, pursuant to Articles 128-135 of the Consumer Code.

– Jurisdiction –

Fattoria Rossi Società Agricola undertakes to comply with all the regulations of the Italian State on distance selling conditions governing online commerce. For any dispute that may unfortunately arise regarding this contract, the competent court of jurisdiction is Reggio Emilia.
